Misdemeanors are offenses, other than violations or traffic infractions, for which jail time in excess of 15 days may be imposed, but which cannot exceed 1 year. A misdemeanor is a crime in New York State, and if convicted, would result in having a criminal record.
The maximum jail sentence upon conviction of a class A misdemeanor is 1 year in jail; and 3 months for a class B misdemeanor. Other types of sentences could also be imposed, such as fines, probation, jail weekends, or any specific conditions imposed by the court.
As such, it is very important to consult an attorney immediately upon receiving any misdemeanor charge(s). You will certainly want to avoid a conviction and/or minimize the worst consequences of one by pursing all available legal means. Engaging the services of an attorney at the earliest possible stage could make a big difference in the outcome of your case.
